PLANNING COMMISSION MEETING MINUTES
September 24, 2012

The regularly scheduled meeting of the Evendale Planning Commission (EPC) was called to order by EPC Chairman (Council Representative) Doug Lohmeier at 6:00 PM on September 24, 2012.   Attending were EPC members Rob Adams, Natasha Cavanaugh, Chris Patterson, and Mark Ferguson.  Supporting the EPC were Jack Cameron (Assistant to the Mayor), James Jeffers (Village Engineer), Pam Morin (Building Department Clerk), James Dobrozsi (Architectural Review Board Member), and Kathy Farro (Legal advisor to EPC) and Ralph Terbrueggen (Landscape Architect).

Public Hearing:

1.      Evendale Zoning Code – Final Draft

Mrs. Dorothy Dover spoke about the need to reconcile the current Zoning Code with earlier maps. Doug Lohmeier reminded her that this would be a legal matter and would need to be treated as such.

Mr. Franklin Barrett, attorney with Barrett Weber, representing Tim Clarke of Netherland Rubber Company addressed the Planning Commission.

Mr. Barrett inquired as to the proposed changes in the Zoning code involving his client’s property, specifically how a change from GI to IF-2 would affect his client. Would his client be losing any property rights, what was the scope of the proposed change, why was that change proposed and would the Village be able to document the changes for his client.

Theresa Claypool, owner of Jack’s Treehouse, a Type-B daycare located on Glendale-Milford Road asked the Planning Commission how Type-A daycare facilities would be treated in the proposed Zoning Code.

There being no others in attendance who wished to comment on the proposed Zoning Code Final Draft, a motion was made by Ms. Cavanaugh, seconded by Mr. Ferguson to close the public hearing. The motion passed 5-0

Old Business:

1.      Evendale Zoning Code – Final Draft

Chris Patterson presented the final version of the Zoning Code revisions to EPC. He worked through the final changes from the May meeting which had been postponed for other business. Specifically, the changes to sections 1244, 1266, and 1286 were made as EPC had instructed.

The one issue that was not discussed at either the ZCoWG level or EPC was the issue of daycare. Type B daycare is a permitted use in Residential areas as required by Ohio law. Type B daycare allows up to 6 children at a time with only 3 children under by the age of 2. Type A Daycare allows for up to 12 children in a facility with only 3 children under the age of 2. Mr. Patterson noted that ZCoWG has accepted staff’s recommendation to align Evendale’s requirements with the State of Ohio but that ZCoWG’s understanding was that Type-A daycare was required by the State as well as Type-B. Understanding that Type-A daycare was NOT mandated by the State, Patterson asked if EPC would like to revisit the issue.

There were a number of points made about the impact to residential areas, the preference of having daycare in commercial areas, the need to mitigate the impact of these facilities on neighbors, the increased oversight that Type-A daycare receives, and the limited number of these facilities statewide.

At the end of the discussion there was general agreement that since Type-B daycare was mandated by the State, the impact to the Village was with the Type-B facilities and that Type-A might be best configured as a conditional use within residential districts.

Kathy Farro was asked to draw up a list of conditions which might address Planning Commission’s concerns and that might be included within the text revision. Those conditions and the final language will be presented at EPC’s next meeting.

With the addition of the Type-A daycare, EPC by consent deferred the vote on the final Draft of the Zoning Code Revisions until next month’s meeting.

Adjournment:

On a motion made and seconded, the meeting was adjourned at 7:35pm on a 5-0 vote.
